Thank you for reviewing the terms and conditions of use (the "Terms") for Superovers, India’s biggest fantasy cricket app. In addition to the Terms, any documents expressly incorporated by reference (collectively, "Terms") govern your ("You" or "Your") access and use of Superovers, the fantasy sports contests and services offered thereon, and all information, documents, content, communications, files, text graphics, audio/visual files, software, applications, and/or related services (collectively, the "Application") available for your ("You," "Your" or "Yourself") use subject to these Terms as set forth below. In addition to this, the Superovers app is not related to and does not claim any official status with any of the official or non-official cricket teams or sports people. Superovers does not promote, support, or encourage betting or gambling in any form.

AGREEING TO THE TERMS AND CONDITIONS

By accessing or using any service from the application, becoming a registered user ("Registered User") of the application, or merely browsing the application, you accept and are bound by these terms. Superovers reserves the right to change the terms at any time, without prior notice to you. In the event the terms are materially modified, a notice of the changes and their effective date will be prominently posted on this page. Your continued use of the application following such changes requires your affirmative consent to the changes. If you do not agree to the changes, your sole remedy is to cease using the application. If you breach any of the terms, your authorization to use the application automatically terminates.

LEGALITY AND ELIGIBILITY

Eligibility:

To be eligible to create an authorised account ("Account") and become a registered user, you must, at the time of registration:

1. Must be at least eighteen (18) years old.
2. Be an Indian citizen or resident with a physical address in India.
3. Be an Indian citizen or resident with a physical address in India.
4. Not be barred from participating in the application under Indian law.

At all times, abide by these terms. Superovers reserves the right to verify your age, identity, location, and other eligibility requirements at any time by any means. Any failure to cooperate with Superovers in this respect may result in the suspension and/or termination of your account.

Employees, officers, directors, investors, agents, and representatives of Codeparticle Technology or Superovers or any of its parent companies, subsidiaries or affiliates, licensees, advertising, promotional, or other agencies, software suppliers, and/or developers, as well as each of their respective immediate family (defined as parents, spouse, and children) and any person residing in the same household as such, are NOT eligible to win. However, such individuals may use the application and will do so from time to time for the purposes of testing the application, evaluating user experience and contests, socialising and competing with customers to build community, and other reasonable and fair uses at the sole discretion of Superovers.

Professional or amateur athletes, sports agents, coaches, team owners, team employees, referees or league officials, any person associated with the team management of any sports league, and their immediate family members, are not eligible to participate in and are strictly prohibited from entering any Superovers contests in the sport in which they are associated.

By accessing or using the application, you represent and warrant that you have the right, authority, and capacity to enter into this agreement, to abide by all of these terms, and that you are not prohibited from accessing and using the application. Superovers makes no implicit or explicit representations or warranties as to your legal right to participate in the application; nor shall any person affiliated, or claiming affiliation, with Superovers have the authority to make any such representations or warranties. Superovers does not intend for the application or the services offered thereon to be used by persons present in jurisdictions in which participation may be prohibited or restricted. You agree that the availability of the application does not constitute an offer, solicitation, or invitation by us for the use of the application in any jurisdiction in which such activities are prohibited or restricted. Superovers reserves the right to deny access to the application to anyone at our sole discretion.

Legality:

As per the legislation of India, games of skill are legal, as they are excluded from the ambit of Indian gambling legislation, including the Public Gambling Act of 1867. The Indian Supreme Court, in the cases of the State of Andhra Pradesh V. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan V. State of Tamil Nadu (AIR 1996 SC 1153), has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience, and adroitness of the player shall be classified as a game of skill.

You are subject to the laws of the jurisdiction in which you reside and/or from which you access the application and the services offered thereon. Access to the application and the services may not be legal for some or all residents of, or persons present in, certain jurisdictions. Legal residents physically located in any of the twenty-nine (29) states and eight (8) union territories, and excluding Telangana, Assam, Odisha, Andhra Pradesh, Sikkim, Nagaland,Karnataka and Arunachal Pradesh (together the "Prohibited Jurisdictions"). Residents of such prohibited jurisdictions are ineligible to open an account or participate in services offered by the application. You agree to abide by all applicable laws in the jurisdiction where you are located while using the application.

If you open an account and/or participate in the services offered on the application while located in a prohibited jurisdiction, you will be in violation of the law of such prohibited jurisdiction and these terms, and subject to having your account suspended or terminated. You hereby agree that Superovers cannot be held liable if laws applicable to you restrict or prohibit your participation.

Superovers makes no implicit or explicit representations or warranties as to your legal right to participate in any service offered, nor shall any person affiliated, or claiming affiliation, with us have the authority to make any such representations or warranties. Superovers does not intend for the application and the services offered on it to be used by people who live in jurisdictions where fantasy sports contests are prohibited or restricted by law. As a result, it is void where prohibited or restricted by law.

USER REGISTRATION

To create an account, go to the application and complete the registration process by verifying your mobile number or email ID. To create an account through the application, you will be required to:

1. Submit your mobile number and other details as requested.
2. Referral code, if you’re referred by an existing registered user.
3. Enable GPS to verify your physical location.
4. Select a unique username and a password (the "Identifiers"). The username must not be offensive, be selected to deceive or misinform other registered users, and may not offend common decency or infringe upon the rights of third parties. If Superovers receives information that a username is illegal or in breach of these terms, the username can be amended by Superovers without prior notice. For security reasons, passwords must differ from usernames and may be changed whenever you deem necessary. Passwords should not be sequences of consecutive numbers (i.e. "2345678") or letters (i.e. "ABCDEFG"). A secure password should contain a combination of numbers, letters, and, when possible, special characters. You are responsible for maintaining the confidentiality of your login names and passwords and accept responsibility for all activities, charges, and damages that occur under your account. You are responsible for ensuring you use strong and secure passwords, and you may be required to change your passwords from time to time.

VALID INFORMATION

You agree to provide true, accurate, current, and complete information about yourself (the "Registration Data") as prompted by the application’s registration form; and-maintain and promptly update the Registration Data to keep it true, accurate, current, and complete. You may modify your registration data by logging into your account and making such changes. Please contact customer service at support@superovers.com for further assistance.Any information collected by Superovers will be held subject to Superovers Privacy Policy and "just-in-time" notices, if any, provided at the point of information collection or use. If you provide any information that is untrue, inaccurate, not current or incomplete, or Superovers has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Superovers reserves the right to suspend or terminate your account immediately and refuse any and all current or future use of the application (or any portion thereof).

ONLY ONE ACCOUNT

Only one account is allowed per person. If Superovers determines that you have registered more than one account, you acknowledge and agree that Superovers has the right to suspend or terminate your account(s), refuse any and all current or future use of the application, and withhold or revoke the awarding of any winnings, in addition to any other rights that Superovers may have.

THERE IS NO TRANSFER

Your account is not transferable. Allowing another person to use your account to participate in a contest is a violation of these terms of service.If you have reason to believe that someone is using your account without your permission, you should contact us immediately. Superovers will not be responsible for any loss or damage resulting from your failure to notify us of unauthorised use.

If Superovers requests registration information from you, you must provide us with accurate and complete information and must update the information when it changes. Under no circumstances shall you allow or permit any other person or third party, including, without limitation, any person under the legal age to participate in the application, and in no event shall you allow or permit any person under the age of eighteen (18) to use or re-use your account in a manner that may violate the standards or laws in any jurisdiction where you are located and/or are a resident, or where such other person is located and/or is a resident.You accept full responsibility for any unauthorised use of the application and any use of your credit card or other payment instruments by any other person or third party in connection with your account.

Any person found to have violated this section may be reported to the relevant authorities and will forfeit all funds in their account. Superovers will not be liable for any loss that you may incur as a result of someone else using your account, either with or without your knowledge, unless you have previously notified Superovers as provided herein that your identifiers are no longer secure and confidential. In the absence of prior notification to Superovers that your identifiers are no longer secure and confidential, you will be liable for losses incurred due to someone else using your account.

VALIDATION OF ACCOUNTS

To verify your account on Superovers, you must send

1. Verify your mobile number.
2. Atleast 18 years of age.
3. Provide us with a declaration that you are not a resident of Telangana, Assam, Karnataka, Odisha, Andhra Pradesh, Sikkim, Nagaland,and Arunachal Pradesh.
4. Enable GPS at all times while you’re using our application.

TAXATION

As per the Income Tax Act 1961, all winnings are subject to a tax deduction ('TDS') according to the Government of India. Whenever the government of India revises the aforementioned rate in the future, Superovers will deduct TDS based on the then-current prescribed rate. For such tax deductions, TDS certificates will be provided to the winners. Winners are also responsible for paying any other applicable taxes on the real money, such as income tax and gift tax.

A SECURE WAY TO HOLD FUNDS

Player funds are held in trust in specified bank accounts. The funds held by Superovers are unencumbered and will be remitted to you in due course, subject to the withdrawal terms and conditions. All funds in your user account are kept separately from the funds held by the company. It is very unlikely that there will be insolvency, but if it does, you will be compensated first, according to the law.
